WHO'S WHO LEGAL : MEDIATION 2017 - Top 7.

Fabienne van der Vleugel, as per page 32 of the WHO'S WHO LEGAL : MEDIATION 2017 has been nominated by her peers as one of the world's leading practitioners in this field.

Associate Professor at the University of Paris-Est Marne-la-Vallée (business law).

Fabienne van der Vleugel, Associate Professor at the University of Paris-Est Marne-la-Vallée (UPEM located in Meaux), is teaching business law.

"Business contracts may be negotiated" : meeting with Fabienne van der Vleugel and members of the assocation 77 Reseau Entreprendre

Fabienne van der Vleugel has been invited by the 77 Reseau Entreprendre association to summarize, during a brief and pragmatic meeting, some advises to obey to, when negotiating a contract.

Substantially, she reminded some "tips and tricks" in this field :

- Carefully read and understand the draft contract, before signing it.
- Nothing is obvious. Nothing is standard. Each word and each clause must be understood, explained and there is no shame to ask questions and require clarifications about words and terms, in order to perfectly understand the sense and importance of engagements. For example, the term "solidarity" entails legal conséquences that must be understood.
- Negotiating is always possible. You may also choose NOT to negotiate and accept the draft contract proposed by the co-contractor. In this case, as such, it is your choice to adhere to his/her proposed draft.
- One must also negotiate the last clauses of the contract : the ones that are always forgotten (the so-called "midnight clauses"). Those clauses are often related to the modalities to be obeyed to, in case of conflict. Parties must choose between judicial trials or arbitrattion. They may also oblige themselves to organize a mediation beforehand.

At the end of the meeting, Fabienne van der Vleugel reminded the audience some steps in order, for a company, to recover the unpaid issued invoices.

Fabienne van der Vleugel, lawyer since 1995, has developped her mediation practice since 2007 - date at which she founded VDV AVOCATS on the territory of SERRIS, Val d'EUROPE.

She is now referred to in the National Mediation Center of Lawyers (in French, Centre National de Médiation des Avocats, CNMA).

She is accredited mediator in the UK (MCIArb), in Luxemburg and Belgium.
