Speaker and moderator during the 18th UIA World Forum of Mediation Centres, Prague, Czech Republic: "Mining the minds of mediators".

The Forum of Mediation Centres was created in 2001 by the Mediation and Conflict Prevention Commission of the UIA (Union Internationale des Avocats).

The Forum brings together the most important commercial mediation and ADR (Alternative Dispute Resolution) centres from around the world and offers an occasion to exchange views on the development of ADR and best practices.

Fabienne van der Vleugel, Vice-President of the UIA World Forum of Mediation Centres, was the moderator for the session "Mining the minds of médiators". The purpose was to discuss directly with the audience about practices in the various countries.

Participation to the seminar "ARBITRATION AND COMPANIES" organized by the CFA (comité français de l'arbitrage).

Company law and arbitration are very much related.

The seminar organized by the French Arbitration Committee (CFA - Comité Français de l'Arbitrage) with the training center of the University Panthéon-Assas has been successuflly handled.

Expériences have been discussed and viewpoints have been explained by specialists in this field.

Participation to the colloque organized by the Paris Bar : "GENERATION MEDIATION : Justice change, and you?"

This 25th October 2012, the PARIS Bar has organized the colloque « GENERATION MEDIATION: justice is changing, and you? ».

This colloque was the opportunity to remind to the audience that mediation is an interesting mechanism, adapted to multiple areas of law (such as, but not only business law, family law, intellectual law), and ensuring economic performance.

Fabienne van der Vleugel has begun to develop mediation in her law firm as from 2008.

At that time, she has opened a specific department for mediation in her law firm and she has participated to various mediation trainings, in France and abroad.

In 2012, the law firm VDV AVOCATS has moved into newly build offices especially designed notably to allow the professional and confidential organization of plenary and private sessions for international or national mediations.

In her quality of attorney at law, specialist in company law, Fabienne van der Vleugel systematically explains to her clients what are the characteristics of mediation. If clients decide to have recourse to this alternative dispute resolution (ADR), she may accompany them throughout the whole process.

As accredited mediator in France, Belgium, UK and Luxembourg, Fabienne van der Vleugel is regularly appointed as mediator either by the judge (judicial mediation), the parties (ad hoc mediation) or by the institution (e.g. : IEAM, ICC ADR, bMediation, CIArb, CMCC).

She is also participating to multiple conferences as speaker, notably the International Forum for the mediation centres and the international competition for commercial mediation organized by the ICC.

The Forum of Mediation Centres was created in 2001 by the Mediation and Conflict Prevention Commission of the UIA (Union Internationale des Avocats).

The Forum brings together the most important commercial mediation and ADR (Alternative Dispute Resolution) centres from around the world and offers an occasion to exchange views on the development of ADR and best practices.

It is also an occasion for centres to collaborate on specific programmes.

The meeting in Zagreb was the 17th since the creation of the Forum.

During this meeting, Fabienne van der Vleugel participated to a practical and interactive session during which experienced mediators have discussed various specific aspects of mediation, with concrete examples.

The purpose of this session consisted in triggering discussions, debates and questions with the mediators of the audience in order to share experiences and compare viewpoints on topics such as:

• Abuse of mediation – How can a mediator prevent it?
• Agreement to mediate and mediation agreement: who is writing what, and how?
• Being an attorney-mediator: issues relating to conflict of interest, impartiality, neutrality, invoicing and liability dilemmas under the professional ethical regulations
• Being a judge and a mediator, two separate functions?

Speaker during the international colloque organized by ESCI (Ecole Supérieure de Commerce Internationale).

Fabienne van der Vleugel is speaker during the 4th international colloque organized by ESCI (Ecole Supérieure de Commerce Internationale).

This 4th International colloque is integrated into a cycle of conferences “Doing business in …”.

The openings of the colloque are organized by M. Guillaume KRAFT, Director of the ESCI and M. Jacques HEMON, Director of the colloque.

The first part of the colloque is dedicated to the importance of the culture in the business and the management.

During this first part, Fabienne van der Vleugel is speaking about “Practicing law with respect of the culture: negotiation of contracts and management of conflicts.”

As lawyer admitted to practice in New York, Brussels and Meaux, she has demonstrated how the practice of law, the negotiation processes and the management of the conflicts may be handled in adequation with the culture differences.
