Continuing training for lawyers : "How may we begin a mediation ?"
In the framework of continuing education for lawyers, Fabienne van der Vleugel has organized a specific session dedicated to mediation and named “How may we begin a mediation? “.
This session was very pragmatic : the purpose was to explain, very straightforwardly, how lawyers may be prepared to mediation, how they explain this process to their clients, how they may accompany them in the negotiating process and how they may finalize correctly the mediation.
Various questions have been analyzed in details :
- How may the lawyer concretely organize to initiate the mediation? - What are the differences between ad-hoc mediation and judicial mediation? - What the advantages and disadvantages of mediation? How may the lawyer explain the characteristics to clients – future mediated parties? - How may we give the idea of mediation when handling a litigation procedure? - Which is the status of mediation today in the judicial environment, before the judicial tribunal? the commercial court? The administrative tribunal? Are there differences between those jurisdictions insofar as mediation is concerned?
Interview : being a business lawyer, specialist in company law, and the enterprises in difficulty
Marie, Fatoumata, Ségolène and Ludivine (Thémis team) are studying a master's degree at the high school program at the ICD business school of Paris.
On March 17, 2021, in the framework of their studies, they have chosen to interview Fabienne van der Vleugel about “Being a practicing business lawyer and the enterprises in difficulty”.
Under the supervision and control of Ms Platiau (trainer IGS) and M. Kittery (head of training), the students have organized a life video interview (at a distance, due to the covid crisis situation), in order to collect practical and sincere information about this subject matter, as spontaneously and frankly as possible.
Fabienne van der Vleugel has accepted to comply with this challenge and to answer any and all questions, naturally, directly and sincerely, speaking to young future managers, the tomorrow's decision-makers who will also have to constantly look for the best equilibrium between private and professional life, the dream to discover new countries and the international life, and the will to enjoy the quality of everyday life, the necessity to study perfectly any and all details of a professional file without forgetting the general and main objective of the client.
The spontaneity of the interview makes it, of course, perfectible. However, students were looking for sincerity and simplicity to provoke ideas to their colleague students, to suggest ambition, to help building professional orientations, and to trigger constructive dynamic and thoughts, in a genuine natural atmosphere.
Challenge has been achieved. It is in that spirit that authorization has been given to ICD business school of Paris (IGS group) to publish the recorded interview within its network.
Conferences with the French Federation Building (department 77, France)
During 2 days – 10 March 2021 and 1st April 2021 – Ms Isabelle MILLET, Assistant to the Directorate of Construction Legal Affairs 77, has organized conferences, with Fabienne van der Vleugel, to explain tips and methods to handle unpaid invoices.
The objective consisted in explaining plainly and very concretely how enterprises may organize internal procedures and ensure adapted treasury management.
It is indeed necessary, for enterprises, and particularly for small and medium businesses, to make sure their invoices are duly paid, in conformity with general sales conditions. In case of recalcitrant debtors, adequate debt collection procedures must be defined.
Three specific time-period have been described : tips for the period BEFORE the execution of the construction site ; advices for the period DURING the execution of the construction site ; what measures to put in place as soon as the entrepreneur is suffering first late payments.
Some examples and concrete situations have been explained to help understanding the consequences and advantages of various helpful methods.
Fabienne van der Vleugel is accompanying various companies, located in Seine et Marne, or other departments, to handle unpaid invoices, by defining strategy and initiating judicial procedures and/or conducting negotiations.
Mediation Week in France : co-speaker at the Round Table "Oser la Médiation".
Fabienne van der Vleugel is co-speaker at the Round Table « Oser la médiation » organized by Ms Picoury, Presidente of the Judicial tribunal of Châlons-en-Champagne, with judge Ms Nadine Del Pin as moderator, with the support of the National association of mediation ("ANM").
This Round Table is organized during the MEDIATION WEEK.
The subject matter developped by Fabienne van der Vleugel is : the role of the lawyer during the mediation process.
Organizer of the virtual 28th UIA world forum of mediation centers.
Every 9 months, the UIA world forum of mediation centers is organized in different countries, and gathers professional mediators, lawyers, students and professors, as well as managers of companies interested in the development of ADR in their enterprises.
In september 2020, the UIA FORUM will be organized in a virtual form, in 4 webinairs.
The program (see below) is promising to be very interesting.
